NOVO YOU HEALTH — LEGAL DISCLAIMERS, TERMS OF SERVICE, AND PRIVACY POLICY
1. Medical Disclaimer & Emergency Notice
DO NOT USE THIS SITE OR TELEHEALTH PLATFORM FOR EMERGENCY MEDICAL NEEDS. IF YOU ARE EXPERIENCING A MEDICAL EMERGENCY, CALL 911 IMMEDIATELY OR GO TO THE NEAREST EMERGENCY ROOM.
The contents of this website, including text, graphics, images, blogs, and information obtained from third-party links, are for informational purposes only. The information provided on this site is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your qualified health provider with any questions you may have regarding a medical condition. Never disregard professional medical advice or delay in seeking it because of something you have read on this website.
2. Provider Professional Identity Notice
Novo You Health is an independent, Nurse Practitioner-owned and operated healthcare practice. Medical and telehealth services are delivered by Advanced Practice Registered Nurses (APRNs / NPs). In jurisdictions where allowed by law, our providers practice with complete Full Practice Authority (FPA) and independent prescriptive authority.
3. Jurisdiction, Licensing, & State-Specific Scope of Care
Telehealth and medical services are strictly limited to individuals who are physically located within the states where our providers are actively licensed at the exact moment of the clinical encounter. We are currently credentialed to see patients in:
Full Practice Authority States: Kansas, Iowa, Washington, Montana, Florida, and Washington D.C.
Restricted Practice States (Missouri & Texas): Telehealth services for individuals located in the states of Missouri and Texas are strictly subject to the availability of an active, state-mandated physician collaborative practice agreement. The clinic reserves the right to restrict, defer, or deny care to Missouri and Texas residents if a compliant collaborative infrastructure is not actively in place.
No patient-provider relationship is established by visiting this website, submitting an inquiry, or filling out a contact form. A formal patient-provider relationship is only established after you have fully completed your clinical intake paperwork within our secure electronic health record (EHR) system, verified your identity, paid the required fees, and your medical profile has been formally reviewed and accepted by a licensed clinician during an active consultation.
4. Telehealth Consent & Prescribing Safety Data
By initiating a consultation through this platform, you acknowledge and agree to the following conditions regarding telemedicine:
Scope of Care: Telehealth involves the delivery of healthcare services using secure electronic audio-visual communications and information technology between a provider and a patient who are not in the same physical location.
Prescription Policy: The initiation of a medical consultation or payment for services does not guarantee that a prescription will be issued. Prescriptions are issued solely at the absolute professional clinical discretion of the treating provider based on medical necessity, laboratory values, and clinical safety profiles.
Controlled Substances Warning: Certain treatments discussed or prescribed on this platform (including, but not limited to, phentermine and testosterone therapies) are classified as DEA Scheduled Controlled Substances. These medications carry strict federal and state tracking requirements. Patients must fully disclose all concurrent controlled substance prescriptions. Misrepresentation of medical history to obtain controlled substances is illegal and will result in immediate termination of care without a refund. We actively monitor and report to state Prescription Drug Monitoring Programs (PDMP). [1]
Compounded Medications: Certain customized treatments utilized by this clinic involve compounded medications. Compounded medications are customized formulations prepared by state-licensed, FDA-regulated outsourcing compounding pharmacies. While prepared using strict quality standards and utilizing FDA-approved active pharmaceutical ingredients (APIs), the final compounded formulation itself is not individually reviewed or approved by the FDA for safety or efficacy.
Risks & Limitations: Potential risks of telehealth include delays in evaluation due to technical failures, lack of access to complete physical medical records, or the inability to perform an in-person physical exam. Both you and your provider retain the right to terminate a telehealth session at any time if it is determined that telehealth is no longer clinically appropriate or safe, and that in-person care is required.
5. Financial, Billing, & Superbill Policy
Novo You Health operates strictly on a Cash-Pay / Fee-For-Service framework. All charges are billed as a flat per-visit fee or an annual fee, depending on the program selected at checkout. We do not utilize recurring monthly subscription models.
Direct Insurance: We do not contract directly with or bill commercial health insurance plans, Medicaid, or Medicare for our specialized weight loss and men's health programs. All payments are due upfront at the time of service.
Superbills: Upon request, we can provide an itemized superbill containing standard ICD-10 and CPT codes corresponding to your per-visit or annual evaluation. Novo You Health makes zero guarantees of insurance reimbursement. Commercial insurance companies frequently exclude coverage for weight loss, lifestyle optimization, compounded pharmaceuticals, and telehealth therapies. It is the patient's sole responsibility to submit superbills and communicate with their insurance carrier. [1, 2, 3, 4]
6. Patient Privacy Policy & HIPAA Compliance Notice
We are committed to protecting the privacy and security of your protected health information (PHI) in strict compliance with the Health Insurance Portability and Accountability Act (HIPAA).
Information We Collect: We collect information necessary to provide safe telehealth services, including your name, contact information, date of birth, medical history, laboratory results, photo identification, and payment details. All medical data is stored securely in our HIPAA-compliant Electronic Health Record (EHR) platform.
How We Use Your Information: Your PHI is used strictly for treatment purposes (such as charting, e-prescribing, or sharing essential data with your assigned compounding pharmacy), healthcare operations (quality assessment and administrative tasks), and secure payment processing.
Disclosure: We will never sell, rent, or lease your personal information, contact data, or medical records to third parties for marketing purposes. We will only disclose your information without your explicit authorization when required by federal or state law (e.g., public health reporting, PDMP tracking, or valid court orders).
Your Rights: You have the right to inspect and copy your electronic medical records, request corrections to your chart, request a restriction on certain uses and disclosures of your information, and request an accounting of disclosures we have made of your PHI.
7. SMS/Text Messaging Communication Consent (A2P 10DLC Compliance)
By providing your mobile phone number and opting into communications, you explicitly consent to receive text messages (SMS) from Novo You Health regarding appointment reminders, clinical updates, billing notifications, and portal alerts.
Privacy Assurance: No mobile information or text messaging opt-in data will be shared with third parties or affiliates for marketing or promotional purposes.
Opt-Out: You can opt-out of text messages at any time by replying "STOP". Message and data rates may apply.
